1872 Licensing Act as I think?  :-\ :P

That was repealed in 1915, and by several others since, at least in civilised bits of the country. Even if it took till 2008 to return to the same hours.

RTA - it's under relavent con and use reguations, or unmodofied comon law.

I think you're wrong - and you're not providing any evidence to support your statements Ian.

The 1872 Act was not repealed - but statute altered by subsequent amendment legislation [Licensing Acts in 1964, 1988, 2003].

The 1915 measures were reductions in opening hours, restrictions on buying alcohol for others and the beginning of increased taxation.

The Road Traffic Act only deals with "propelled vehicles"; Section 30 explicitly deals with cycles. Horses are not mentioned - at least, not anywhere that I can find - and until you provide me with a direct reference to the contrary, I'll go with 1872 as the statute that creates the offence: because that is the legislative basis, it does not require common law.

I'm happy to be corrected on this - and may well be wrong - but, scholar that I am, you need to prove it with evidenced fact, not statements of assertion.  :)

Can you be charged for riding a cycle or horse whilst under the influence?

Yes, but as neither is a mechanically propelled vehicle, they do not fall within this part of the Road Traffic Act. It is an offence under Section 30(1) to ride a bicycle, tricycle or cycle having 4 or more wheels whilst under the influence of drink. #
Pursuant to Section 12 of the Licensing Act 1872, it is also an offence to be riding a cycle or to be in charge of any carriage, horse or cattle when drunk. Note, that it needs to be established that the Defendant is "drunk" not merely effected by alcohol.

A recent joint study conducted by the Department of Health and the Department of Motor Vehicles indicates that 23% of traffic accidents are alcohol related. This means that the remaining 77% are caused by idiots that just drink coffee, juices, carbonated drinks, milk, water, and crap like that. Therefore, beware of those who do not drink alcohol.

They cause three times as many accidents.

Yeah, but drinking and pedalling a small, mobile nissen-hut deserves a catagory of its own.  :D

My grandfather had a bicycle that was self propelled and knew it's way back home from any pub in our home town.

Leastways that's what my grandmother reckoned seeing as he always managed to get home on his bike, no matter how drunk he was.

I got a lift home once in one of those particular Land Rovers in Cornwall, after my car had broke down in the middle of nowhere!  I'd already walked 2 miles in the dark, after the lift I wished I'd continued on foot...  X_X

My brother, who works in a south Devon pub, always got home because the lane between the pub and his house was the same width as his car...  ;)
