anyone on the forum familiar with UK copyright law, I have a couple of questions

Not totally familiar, but....

The basis is that you cant copy until 25? Yrs after the IP originator's death (that might have been extended) but with written material you may copy up to 10% for purposes of review, study and research, so that you can quote. These must be acknowledged when used.

I think they extended that to 75 years from the year of the author's death, so quite a long time.  Something like Mozart or Jules Verne's novels would usually be out of copyright, unless that copyright has been extended/renewed by their estates I believe.  Ian's right on the 10% for research and reviews. 

There's also some grey area if you're working in a different mediums I believe?  So you could produce a sculpt of a written word character without it being an infringement, but if you sculpted a movie/TV character exactly as they were depicted in the movie/TV programme you'd be in hot water.  We had an interesting email from HG Wells' estate years ago, claiming we were impinging on their IP with our martian tripods.  We checked with an IP lawyer and found that they couldn't claim copyright on the term 'tripod' or 'martian' and that our sculpts were not how the tripods are described in War of the Worlds anyway, they were simply tripods that some generic martian/alien species used.  We dropped 'Martian' from the description just to be on the safe side and we've not heard from them since.

But if it's something you need a definite answer on, you're probably better off with a legal mind rather than us lot!

I read one description that said, basically, the duration of copyright is 10 years longer than it's been since Walt Disney died. Every time his copyright approaches, the duration mysteriously extends...

That's because Walt Disney had his head cryogenically preserved so technically he is still alive

it concerns photographs my father took of WW2 warplanes that he restored while he was in the RAF I have discovered that they have been published on the net with an individual claiming copyright. My father still has the negatives and original photos and he has never given anyone permission to publish them neither has the RAF. No one else took photos of the planes only my father and the only other person there at the time was me, photos taken between 1969-1971.  I was only given copies of the photographs a few years ago.

I am no expert but  I would try the following :-

I would send the person a letter requesting they cease and desist using the photographs and demand they remove them from the internet. Point out your father took them and you have the originals. Do not mention the negatives  State that if they have not done this within 14 days you will regard ths of acceptance of your copyright and  you will be invoicing hem with your copyright fee of  X per photo ( make sure X is large ie £75+ a photo) for the use of your photographs  and if the invoice is not paid you will take them to the small claims court for the monies owed (this costs about £80 for a claim up to £1000).

The reason I say not to mention the negatives is that if you go to court the negatives should prove your legitimate ownership.  It is possible to obtain negatives from a photo, by taking a photo of a photo. By not mentioning you have the negatives they will hopefully not look into this.
